Terms of Service

These Terms of Service ("Terms") govern your access to and use of CaliberVisual (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Accounts
You must provide accurate information when creating an account and are responsible for keeping your credentials secure and for all activity under your account. You must be at least 18 years old to use the Service.
2. Subscriptions and billing
The Service has a free plan and paid monthly plans. What each plan includes and what it costs is set out on our pricing page; the price shown there at the time you subscribe is the price you pay, and we will give you notice before any change to it takes effect. Paid plans are billed through our payment processor, Polar, on a recurring monthly basis until cancelled.
You can cancel at any time from your billing settings. Cancellation takes effect at the end of the billing period you have already paid for; you keep access until then and are not charged again.
Refunds
Because the Service is delivered immediately and the free plan lets you try it before paying, fees already charged are non-refundable, except where a refund is required by law (including any statutory right of withdrawal that applies where you live) or where we charged you in error. Refund requests go to support@calibervisual.com.
3. Your content
You retain ownership of the brand assets, animations, and other content you create or upload. You grant us a limited licence to store and process that content solely to provide the Service. You are responsible for ensuring you have the rights to any assets you upload.
4. Acceptable use
You agree not to misuse the Service, including by attempting to disrupt it, reverse-engineer it, or use it for unlawful or infringing purposes.
5. Termination
We may suspend or terminate access if you breach these Terms. You may stop using the Service and delete your account at any time.
6. Disclaimer and liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect or consequential damages arising from your use of the Service.
7. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
8. Governing law
These Terms are governed by the laws of the country in which CaliberVisual is established, without regard to its conflict-of-law rules, and any dispute is subject to the courts of that country. If you are a consumer, nothing in these Terms takes away the protections you are entitled to under the mandatory law of the country where you live.
